SECTION 1 – COPYRIGHT & INTELLECTUAL PROPERTY
All content on the Site is the exclusive property of Gathered Seams and is protected by Canadian and international copyright laws. You receive a limited, non‑transferable, non‑exclusive license to access the Site for personal use only. You may not reproduce, copy, modify, distribute, sell, sublicense, publicly display, upload, or transmit any content without prior written permission. Digital patterns, tutorials, downloads, images, and instructions may not be shared, resold, mirrored, or posted elsewhere.
Unauthorized use constitutes copyright infringement. If you believe copyrighted material has been posted on the Site without authorization, you may submit a takedown request including your name, identifying the material, the URL where it appears, proof of ownership, and a signed statement that you are authorized to act on behalf of the rights holder.
SECTION 2 – DIGITAL PRODUCT TERMS
All digital product sales are final. Due to the nature of digital goods, refunds, cancellations, or exchanges will not be issued except in cases of duplicate purchase or technical failure at our sole discretion. Users are responsible for verifying email accuracy and ensuring their device supports the file format. You may not redistribute, resell, or supply copies of digital products.
SECTION 3 – USER OBLIGATIONS & PROHIBITED CONDUCT
Users agree not to:
• Engage in unlawful activity while using the Site.
• Attempt to breach, disable, or hack website functionality or security.
• Introduce viruses, malware, or harmful code.
• Scrape, harvest, or extract content, data, or files using automated systems.
• Interfere with normal Site operations.
• Impersonate others, misrepresent identity, or post false information.
• Copy, reverse engineer, or exploit any part of the Site.
We reserve the right to terminate access, block users, revoke licenses, or pursue legal remedies for violations.
SECTION 4 – LIMITATION OF LIABILITY
To the fullest extent permitted by law, Gathered Seams, its owners, affiliates, contributors, and licensors shall not be liable for any direct, indirect, incidental, consequential, punitive, exemplary, or special damages arising out of your use of the Site, its content, or digital products. This includes, without limitation, damages for injury, loss of data, business interruption, loss of profits, sewing accidents, or inaccuracies in tutorials.
In no event shall our total liability exceed the amount paid by you for the product or service that gave rise to the claim, or $10 CAD if no purchase occurred.
SECTION 5 – WARRANTIES DISCLAIMER
The Site and all content are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied. We disclaim all warranties, including fitness for a particular purpose, reliability, accuracy, completeness, merchantability, and non‑infringement. We do not warrant that the Site will be uninterrupted, secure, error‑free, or free of harmful components.
SECTION 6 – INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Gathered Seams, its owners, partners, affiliates, contractors, service providers, and agents from any claims, liabilities, damages, losses, expenses, or legal fees arising from your use of the Site, violation of these Terms, misuse of content, copyright infringement, or any actions related to your sewing activities.
SECTION 7 – GOVERNING LAW & DISPUTE RESOLUTION
This Agreement is governed exclusively by the laws of Alberta, Canada. Any disputes shall be resolved exclusively in the courts located in Alberta. Users waive any right to participate in class actions or collective claims.
SECTION 8 – SEVERABILITY
If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall continue in full force without limitation.
SECTION 9 – ENTIRE AGREEMENT & MODIFICATIONS
This Agreement constitutes the entire understanding between you and Gathered Seams. We reserve the right to modify this Agreement at any time. Updates will be posted with a revised date. Continued use of the Site signifies acceptance of all changes.
